These Terms of Use ("Terms") govern your use of the Swoop iOS app, provided by Neurit Software Kft. By downloading or using Swoop, you agree to these Terms. If you do not agree, do not use the app.
Swoop lets you log body weight and food, estimates calories and macronutrients from photos, and combines that with activity data from WHOOP or Apple Health to show your daily energy balance and a goal-based plan.
Swoop is provided for general informational and self-tracking purposes only. It is not a medical device and does not provide medical, nutritional, or professional health advice. Calorie targets, macronutrient targets, and estimates are not a substitute for advice from a qualified professional. Always consult a doctor or registered dietitian before making significant changes to your diet, exercise, or weight. Do not rely on Swoop for any health decision.
Nutrition and weight values produced from photos are automated estimates and may be inaccurate. You are responsible for reviewing and correcting any estimate before relying on it. Swoop provides these estimates without any guarantee of accuracy.
If you connect WHOOP, you authorize Swoop to access your WHOOP data as described in our Privacy Policy, and you agree to comply with WHOOP's own terms. Swoop is an independent app and is not affiliated with, endorsed by, or sponsored by WHOOP.
Swoop offers an optional auto-renewing subscription, Swoop Pro, which unlocks logging and other paid features.
Your use of the subscription is also governed by Apple's Standard End User License Agreement: https://www.apple.com/legal/internet-services/itunes/dev/stdeula/.
You agree not to misuse the app, including attempting to access it in unauthorized ways, interfering with its operation, or using it to violate any law or the rights of others.
Swoop, including its software, design, and content we provide, is owned by Neurit Software Kft and protected by applicable law. Your logged data and photos remain yours. Product names of third parties, including WHOOP and Apple, belong to their respective owners.
The app is provided "as is" and "as available", without warranties of any kind, whether express or implied, including fitness for a particular purpose and non-infringement, to the fullest extent permitted by law. We do not warrant that the app will be uninterrupted, error free, or that estimates will be accurate.
To the fullest extent permitted by law, Neurit Software Kft is not liable for any indirect, incidental, or consequential damages, or for any health outcome, arising from your use of the app.
You may stop using the app at any time and delete it. We may suspend or end the service, or your access, if you violate these Terms.
We may update these Terms from time to time. Continued use of the app after an update means you accept the revised Terms.
These Terms are governed by the laws of Hungary, without regard to its conflict-of-laws rules.
